Cyster Plate terms of use
These terms are an agreement between you and the developer of Cyster Plate ("we", "us"). They cover your use of the Cyster Plate iPhone app, the website at cyster.cobena.dev and the hosted service behind them. By using Cyster Plate you agree to these terms and to our privacy policy. If you do not agree, please do not use it.
1. Who may use Cyster Plate
You must be at least 13 years old. Cyster Plate is currently offered through the US App Store. If you are under the age of majority where you live, please use it with a parent or guardian's permission.
2. What Cyster Plate is, and what it is not
Cyster Plate is a journal and educational tool. It helps you record meals, how you feel, periods and water, and shows you your own patterns. It also includes recipes and educational lessons that cite their sources.
Cyster Plate is a journal and educational tool, not medical advice. It is not a medical device. It does not provide medical, nutrition or professional advice, it does not make medical judgments about you, and it does not replace your doctor. Nothing in the app, on the website or in an AI estimate is a medical finding. Check with your doctor before making medical decisions, including decisions about food, symptoms, cycles or any health condition. If you think you are having a medical emergency, contact your local emergency services.
Nutrition values from photos or typed text are estimates. They can be wrong. Please check them, and edit any number before you save. Values from barcodes, labels and food databases can also contain errors.
3. Acceptable use
You agree to:
- Use Cyster Plate for your own personal journal, and not to assess or advise another person.
- Keep your device secure. Your journal lives on your phone, so we cannot recover it if you lose it or delete the app without exporting it.
- Follow the law and Apple's rules.
You agree not to:
- Copy, resell, sublicense or reverse engineer the app or the service, except where the law allows it.
- Interfere with, overload or try to gain unauthorized access to the service, other people's accounts or our systems.
- Use automated tools to send photos or text to the AI features, or try to get around the daily limits.
- Send content that is unlawful, or that you do not have the right to send.
- Use the app to ask for or give medical advice.
We may limit or suspend access if these rules are broken.
4. AI estimates
AI estimates are optional. When you allow them, the photo or text you submit is sent through our server to Google to produce an estimate, as described in the privacy policy. You are responsible for what you submit, so please do not send photos of other people or content you have no right to send. The free plan includes a limited number of AI estimates each week. Plus raises the limit. Both limits are weekly, and we may adjust them to keep the service available. Failed or timed-out requests are not counted.
5. Subscriptions and purchases
Free plan. The free plan includes AI photo and text estimates (4 a week, resetting Monday) and unlimited barcode, label, search and manual logging, plus check-ins, periods, water and recipes. Free also shows your top weekly pattern, the last 4 weeks of Progress and one full doctor summary. Plus adds up to 50 AI estimates a week, More ideas for swaps, all patterns, full history and unlimited doctor summaries.
Plus. Plus is available as an annual subscription or as a one-time lifetime purchase. The price and period are shown in the App Store and in the app before you buy. They are charged by Apple.
Annual subscription. Plus annual renews every year unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID at confirmation of purchase. Your account is charged for renewal within 24 hours before the end of the current period at the then-current price. You can manage or cancel your subscription at any time in your iPhone's Settings, under your name and Subscriptions. Deleting the app or your Cyster Plate account does not cancel it. If you cancel, you keep Plus until the end of the period you paid for.
Lifetime. Plus lifetime is a one-time purchase that does not renew. "Lifetime" means for as long as we offer Plus in Cyster Plate. If we ever stop offering Plus, we will tell you in the app before we do and will honor the purchase as far as the law requires.
Restore. If you reinstall the app or use a new iPhone, tap Restore Purchases on the paywall or in Settings.
Refunds. Apple handles all payments and refunds. Request a refund through Apple.
Price changes. We may change prices for future purchases. If a price change affects an active subscription, Apple's rules apply and you will be notified as Apple requires.
Hardship access. If you cannot afford Plus, the app offers a request form. If it is accepted, we add 12 months of Plus to your account at no charge. This is limited to one per device and may be queued when there are many requests.
6. Your data and content
Your journal belongs to you. You give us only the limited permission we need to run the features you use, such as sending a photo you chose to submit to our AI provider to produce an estimate. You can export your data and delete your account in the app at any time. See the privacy policy for how data is handled.
7. Content and third-party services
Cyster Plate uses food data from USDA FoodData Central and Open Food Facts and displays recipes adapted from US government nutrition programs, with credit shown on each recipe. Those sources are not affiliated with Cyster Plate and do not endorse it. Educational lessons cite the sources listed on our sources page. Links to other websites are provided for your convenience, and we are not responsible for their content. Third-party services such as Google, RevenueCat and Apple have their own terms.
8. Accuracy and no warranty
Cyster Plate is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not warrant that estimates, recipes, patterns or lessons are accurate, complete or suitable for you, or that the service will be uninterrupted or error free.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or loss of use, arising from your use of Cyster Plate. To the maximum extent permitted by law, our total liability for any claim relating to Cyster Plate will not exceed the greater of the amount you paid us through the App Store in the 12 months before the claim and 50 US dollars. You are responsible for the decisions you make about your own health. Some places do not allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
10. Termination
You may stop using Cyster Plate at any time and can delete your account and data in the app. We may suspend or end your access if you break these terms or misuse the service, or we may end the service with reasonable notice where possible. When access ends, your right to use the app ends, and sections that by their nature should continue (including sections 2, 8, 9 and 13) continue. Your journal data stays on your phone unless you delete it.
11. Changes to these terms
We may update these terms. Each version has a number and an effective date at the top. If a change is material, we will tell you in the app. Using Cyster Plate after a change takes effect means you accept the new terms.
12. Apple
This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app where required, and, to the maximum extent permitted by law, Apple has no other warranty obligation for it. We, not Apple, are responsible for addressing any claims about the app, including product liability claims, legal or regulatory compliance claims, and consumer protection claims, and for any third-party intellectual property claims. You represent that you are not located in a country subject to a US embargo and are not on a US list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow the terms of any third-party services you use alongside the app.
13. Governing law
These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules, and disputes about them will be heard in the courts located in New York County, New York, except where your local consumer law requires otherwise.
